Course Description:
Over the last few years, the Supreme Court has changed the shape of intellectual property law principles. Thus, professionals in this field cannot remain stagnate in their understanding of the law, but must instead learn to adapt to the ever-evolving landscape. This program will provide an analysis of intellectual property law cases decided by the Supreme Court in the past and in recent years and provide insight into the possible new "messages" the Supreme Court is sending. The main focus will be on patent cases, but trademark and copyright cases will be discussed as well.

Course Description:
After much anticipation and speculation, the Supreme Court handed down a not-so-decisive decision in Bilski. Despite finding the claims at issue to be ineligible for patenting as abstract ideas, the Court refused to categorically exclude all business methods from the patent system. The Court’s application of the abstract idea doctrine and dismissal of the State Street Bank useful, concrete, and tangible test failed to deliver a new test to help practitioners determine the distinction between a patent-eligible process claim from an ineligible abstract idea. In this program, we will explore the practical impact of the Supreme Court’s Bilski decision on day to day practice across multiple technologies, including business methods, software, medical diagnostics, and gene patent claims.

IMPORTANT PROGRAM UPDATE: The Patent and Trademark Office on July 27, 2010, published and requested public comment on a document providing guidance on applying the Bilski decision to determine patent eligibility for process claims. 75 Fed. Reg. 43922. The Federal Register notice, entitled “Interim Guidance for Determining Subject Matter Eligibility for Process Claims in View of Bilski v. Kappos,” reminds examiners that “§101 is not the sole tool for determining patentability; where a claim encompasses an abstract idea, sections of 102, 103, and 112 will provide additional tools for ensuring that the claim meets the conditions for patentability.” The notice, which is open for public comment until September 27, 2010, includes the selection of specific factors below for consideration when determining whether a claim is patent eligible. Course Description:
Cloud computing refers to new technologies and services that hold the promise of divorcing a user of Information Technology services, such as corporate e-mail, from an underlying IT infrastructure. As a result, cloud computing may lower costs while increasing business agility. It is, however, an open question in our highly regulated business environment as to what extent businesses can reasonably make such a radical transformation. This program will explore cloud computing from both a technical and contractual perspective, highlighting some of its legal challenges including e-discovery, privacy, compliance, as well as intellectual property matters that may influence the decision of whether to use or offer a cloud service.
